This matter is before the court upon the Magistrate Judge’s recommendation that Defendant Lane Cribb’s (“Cribb”) Motion for Summary Judgment be granted and Defendant Michael Schwartz’s (“Schwartz”) Motion for Summary Judgment be denied.
