In his own words, Richard B. Lynch (“Defendant”) “beat the crap out of’ James Hagston’s vehicle with a brand new Louisville Slugger baseball bat. He was found guilty by a jury of property damage in the first degree, a class D felony, in violation of section 569.100, and sentenced to serve one year in the county jail. 1 Defendant appeals, contending that the trial court committed plain error in failing to sua sponte modify the verdict-directing jury instruction to include the issue of “claim of right,” which Defendant asserts was available to him under section 569.130.…
