The above captioned action comes before us, pursuant to the parties’ cross-motions for summary judgment, for review of a decision by the Secretary of Health and Human Services denying the plaintiff reim bursement under Title XVIII of the Social Security Act, 42 U.S.C. § 1395 et seq., for certain legal and advertising/public relations expenses it incurred during its cost reporting years 1981 and 1982.
