This matter comes before the Court on defendant’s motion to dismiss (Dkt. No. 6), and defendant’s motion for partial summary judgment (Dkt. No. 13). Plaintiffs, in their opposition brief, request that the Court defer consideration of the motion for partial summary judgment pursuant to Rule 56(f) (Dkt. No. 10).
