On April 9, 2007, Julian Rubio, Jr., filed this action for violations of the Federal Employers’ Liability Act and the Safety Appliance Act against his former employ er, BNSF Railway Company. (Doc. 1, 12, 23.) On July 31, 2007, Mr. Rubio’s local counsel filed a motion for admission pro hac vice on behalf of R.L. Pete McKinney and Patrice McKinney, who are licensed to practice law in Texas. The motion stated that the McKinneys had been provided “the New Mexico Rules of Court.” (Doc. 13.)
