Appeal from District Court, Wood County; M. B. Briggs, Judge. Action by I-Iomer W. Carson against the Winnsboro Cotton Oil Company. Judgment for plaintiff, and defendant appeals.

Appellee sued appellant, a private corporation, for damages for personal injuries alleged to have been negligently inflicted by appellant. Appellant conceded the injury, but alleged that it was due to ap-pellee’s contributory negligence, or was the result of the risk assumed by appellee as an employé of appellant; also that appellee was the representative of appellant in control and management at the time he was injured, or its vice principal, and for that reason not entitled to recover; and, finally, that an adjustment of the claim for injuries was had between the parties.
