The defendants in error, A. Hicks and Howard Hicks, sued the plaintiff in error, Poindexter, to recover a balance due upon a rental contract for the occupancy of a building in Tyler, Tex., and to foreclose a landlord’s lien on certain personal property- described in the petition. After a trial before the court without a jury the findings of fact and conclusions of law were filed, of which the following is the substance:

A. Hicks and Howard Hicks were the owners of a two-story business house situated in Tyler, the ground floor of which consisted of a storeroom 40 feet wide and 70 feet long.…
