This matter is before the Court on the petition of Richard Joseph Gagne for a writ of habeas corpus. Gagne is presently serving a life sentence at the Massachusetts Correctional Institution at Norfolk, as the result of his conviction in the Massachusetts Superior Court sitting in Hampden County on February 20, 1973, for the crime of murder in the second degree. Gagne alleges in his petition that he has been imprisoned pursuant to an illegal sentence in that he was denied due process of law as guaranteed by the Fourteenth Amendment.
