delivered the opinion of the court.
Originally, between Cedar street and Kent’s creek Winnebago street, running north and south in the city of Bockford, crossed a low place. Numerous switch tracks of the Burlington and Milwaukee railroads crossed this space making travel inconvenient, and a viaduct was built, over which the public traveled. The south end of the viaduct rested upon a stone abutment about 14 feet high on the south bank of the creek and on a level with Winnebago street at that point.
