This case is on remand from the Supreme Court. 313 Or 158, 830 P2d 203 (1992). Plaintiff, who was injured in an automobile accident, is the assignee of the insured driver’s claim against her insurer. The insurer refused coverage and failed to defend the insured against plaintiffs claim. Plaintiff seeks recovery from the insurer for the amount of the default judgment that she obtained against the insured, which exceeds the policy limits.
