MORROW, Presiding Judge.
Conviction is.for murder; punishment fixed at confinement in the penitentiary for a period of twenty-five years.
The deceased, Don Turner, and appellant were together on the night of January 4th at the home of the witness Thomas. There was evidence that they had been drinking intoxicating liquor. They left the home of Thomas together, apparently in a friendly mood towards each other, and were riding in a buggy drawn by a mule.
