I. Introduction
This matter is before the Court pursuant to Defendant Hans M. Mark’s Motion for Summary Judgment under Fed.R. of Civ. Proc. 56(b). Defendant Mark is the Secretary of the Air Force (hereinafter referred to as the Government), and is the only remaining defendant herein, as ASD Computing Center was dismissed as a party defendant by order of Judge Carl Rubin on May 7, 1980.
