This case is brought into this court on appeal from an interlocutory judgment of the court below, rendered on a demurrer to an indictment against the defendants for manslaughter, whereby the demurrer was overruled and the defendants required to plead. It was owing to the peculiar circumstances of the case, with the prospect of a very protracted, laborious and expensive trial, that this court deemed it proper and to be in the interest of justice to allow the defendants to bring their case here by an appeal, and to be heard as to whether there…
