Procedural History

Tina Marie Carter brought a tort action under the Virginia Tort Claims Act (“ VTCA” ) for injuries sustained from the alleged negligence of Dr. Gisele Claridge at the University of Virginia Medical Center (“ UVMC” ). Ms. Carter’s initial pleading, filed January 10,2000, named Dr. Claridge and UVMC as defendants. The doctor was dismissed as a defendant by order of this Court dated August 23, 2000, because she is an employee of the Commonwealth and meets the test for sovereign immunity.
