This was an application for a writ of mandamus to compel the municipal authorities of Kansas City to reapportion the cost of grading a part of Washington Avenue. A petition for the improvement was presented to the mayor and council in July, 1888 ; in the following month the petition was granted and an ordinance passed directing that the improvement be made. Estimates of the work were made, the contract let to the lowest responsible bidder, and the grading was done.
