On January 9, 1939, Ruffle Lundon was by a grand jury of Alachua County, Florida, indicted for the crime of murder in the first degree in the unlawful killing of James Robinson on the 29th day of November,' 1938. He was duly arraigned and on the 10th day of January, 1939, entered a plea of not guilty, and shortly thereafter was placed on trial and by a jury convicted of murder in the first degree, without recommendation to mercy.
