Reversing.
Following liis indictment by the grand jury of Breckinridge county for the murder of Sam Haycraft, the appellant, Charles Miller, a negro, was tried in the circuit court of that county for the crime, by verdict of a jury found guilty and his punishment fixed at death. The appellant filed a motion and grounds for a new trial, but *705the motion was overruled by the court, sentence pronounced and judgment entered in conformity with the verdict.
