SHARPNACK, Chief Judge.

This case is another phase in the effort of Indiana Gas Co. ("Gas Co.") to prevent the Indiana Utility Regulatory Commission ("Commission") from implementing its interpretation of the "earnings test" in processing applications for gas cost adjust ments. The first phase resulted in the decision of the third district in Indiana Gas Co. v. Office of Utility Consumer Counselor (1991), Ind.App., 575 N.E.2d 1044.
