This is a motion for summary judgment in lieu of complaint, brought under CPLR 3213, based on a cognovit judgment from the State of Pennsylvania. The judgment was entered by the prothonotary, Clerk of the Court of Common Pleas, prior to the defendant’s default. Such a procedure is permissible under Pennsylvania law. (Pennsylvania Rules of Civil Procedure, Pa Cons Stats Ann, tit 42, § 2951, subd [a].)
