APPEAL from the Vigo Circuit Court.

1Opinion of the CourtHanna, J.

Otis McCullough sued James McCullough in an action of debt, under the old form of practice, on an award, &c. The declaration contains five counts.

The first, is upon a bond in the sum of 2,000 dollars for the performance of an award.

*488The second, is on an award.

The third, is for money had and received.

The fourth and fifth, are substantially the same as the second.

The award declared on is as follows:

“Whereas, Otis and James McCullough have, by then.' respective bonds, dated March 3, 1843, mutually submitted certain matters of difference between them, in the conditions of said bonds specified, to…
