case is before'the court on appellant’s motion for rehearing. After quoting a portion of the original opinion, in which the propriety and legality of certain expressions regarding allegation and proof of ownership and possession, was questioned, appellant cites a large number of authorities to show that we were in error in our original opinion. As will appear later herein, the original opinion will be modified because same ,was not in conformity .with the facts in the instant case.
