WEINFELD, District Judge.
Libelant Geraldo Lopez Victoria seeks to recover maintenance and cure for injuries sustained on or about May 31, 1955 while he was in the service of the respondent as a merchant seaman on its vessel the SS Marine Leopard which was then moored at Stockton, California. About 6:30 P.M. on May 30th libelant was granted shore leave and took his recreation in the traditional way by going directly to a tavern where, by his own admission, he consumed the contents of six 12 oz. bottles of beer within two hours.
