Langdon v. Langdon
West Virginia Supreme Court
1Per curiam
The appellant, Dorothy Mae Langdon, appeals a final order of the Circuit Court of Cabell County dated March 9, 1988, which denied her petition to set aside the final divorce decree. Mrs. Langdon contends that the final divorce decree should be set aside on the grounds that the property settlement agreement she entered into with the appellee, William H. Langdon, Jr., was based upon a mistaken value of his retirement income. We find that this case should be remanded to ascertain the value of the appellee’s pension and to set the appellant’s share of the retirement benefits.
