The defendant was convicted of murder in the first degree for the killing, on the third of October, 1885, of Sergeant Alonzo Bowman. The following is the substance of the evidence:
Dr. Hubbard testified that he was a surgeon in the army, stationed at Fort. Bayard, and that on the third of October he was called upon to attend the deceased, at Central City. He reached him about half past 12 o’clock at night; found him suffering from a gunshot wound through the neck.
