Upon the hearing of this appeal the learned counsel for the appellants makes the same objections to the defendant’s counterclaim that were made in the court below, and insists that the demurrer to such counterclaim should have been sustained —first, on the ground that it does not state facts sufficient to constitute a cause of action, and second, that the facts set out therein are not pleadable as a counterclaim in said action.
