WOLFSON, United States Magistrate Judge.
Presently before the Court is the motion by third party defendants, American Reliance (“American Reliance”) and Vik Brothers Insurance Company (“Vik Brothers”) as successor to American Reliance Insurance Company, (hereinafter jointly referred to as “American Reliance”), to set aside a settlement that was reached between Excelsior Insurance Company (“Excelsior”) and Penns-bury Pain Center (“Pennsbury”).
