The defendants having been arrested and charged with violations of sections 165.45 and 155.30 .of the Penal Law of the State of New York (more commonly referred to as “shoplifting”), moved the court to suppress statements made by them. It is conceded that they were never advised of their rights before they made their statements, in that the statements were taken before any advice or rights, Miranda or otherwise, were given to either of the two defendants.
