OLIVER-PARROTT, Chief Justice.

The trial court granted appellee’s, Terrance Small’s, petition for expunction and entered its findings of fact and conclusions of law. The Harris County District Attorney appeals.

*742A grand jury indicted Terrance Small for the offense of possession with intent to deliv-. er a controlled substance. Before trial commenced, Small filed a motion to dismiss based on entrapment as a matter of law.
