In this action plaintiff seeks to recover damages for personal injuries suffered on one of the streets of the city of Hot Springs. The defendants named' are Walter Havens, People’s Telephone & Telegraph 'Company, and Fidelity & Deposit Company. The defendants telephone and telegraph company and Fidelity Company appeared separately, and each demurred to the complaint on the ground, among others, that the complaint does not state facts sufficient to constitute a cause of action.
