The plaintiff, Champions Golf Club, Inc., of Houston, Texas, brought suit pursuant to the Lanham Act, 15 U.S.C. § 1051 et seq., alleging that the defendant, The Champions Golf Club, Inc., of Nicholasville, Kentucky, committed service mark infringement and unfair competition through false designation. The district court issued a judgment for Nicholas-ville following a bench trial, concluding that there was no likelihood of confusion in the parties’ use of the CHAMPIONS mark.
