Pending before the Court is a Motion to Dismiss filed by defendants on March 7th, 2006. (Docket No. 19). For the reasons discussed below, the Courts GRANTS the Motion.
FACTUAL AND PROCEDURAL BACKGROUND 1
On October 28th, 2004, Luis Cepeda Martinez (“Cepeda Martinez”) was on the seventh floor of the Torre Sabana Housing Project when, between 5:00 and 6:00 a.m., the Puerto Rico Police conducted a raid on the premises.
