This suit was brought in the name of appellee, Stewart & Stevenson Services, Inc., but for the benefit of its insurer and subrogee, The Insurance Company of North America, against Emanuel Gillette, purchaser of an engine from Stewart & Stevenson Services, Inc., and appellant, Continental Insurance Company which issued a policy of insurance covering Mr. Gillette’s fishing boat, the Margaret R.
