In the year 1931, a written contract existed between the Safety First Bus Company of Amarillo, Texas, hereinafter called the Bus Company, and the Fisk Tire Company, Inc., hereinafter called the Fisk Company, under the terms of which contract the last mentioned company furnished the use of its tires to the Bus Company, during the life of the contract, for which use the Bus Company was to pay on a mileage basis.
