On August 16, 1957, appellee brought a suit against appellant and the members of the Canvassing Board of the Town of Bel-lair Shore, such action contesting the election on August 15, 1957 of appellant as mayor-commissioner of the town. The expressed ground for the contest was that 14 of the 29 votes cast at the election were cast by persons allegedly not qualified to *716vote because of the fact that they were “non-residents” of the municipality.
