MEMORANDUM OF DECISION
DILLIN, Chief Judge.
This case represents a challenge by 61 Indiana hospitals, which participate as providers of services under the Medicare program, to a reimbursement policy of the Department of Health and Human Services (“HHS”), the federal agency having administrative responsibility for the program. The hospitals claim that they are not being reimbursed sufficiently because of the practice of HHS to include patients in the maternity labor/delivery area of hospitals as users of “routine services” in the computation of the average per diem cost of routine patient care.…
