This is a civil action brought pursuant to 42 U.S.C. § 1395oo (f) to review a final decision of the Secretary of the United States Department of Health & Human Services (“the Secretary”). The plaintiffs are Virginia hospitals who are approved providers of hospital services under Title XVIII of the Social Security Act, 42 U.S.C. § 1395 et seq. Title XVIII establishes a federally-funded health insurance program for the elderly and disabled known as Medicare.
