This suit was brought by A. L. Stivers to recover of the Texas & Pacific Railway Company damages for personal injuries alleged to have been sustained by him while a passenger in a derailment and wreck which occurred on that railroad on June 17, 1916, near Putnam, in Callahan county. Briefly stated, the petition alleged, and the undisputed facts show, that on the date and at the place above given A. L. Stivers was a passenger on the west-bound Sunshine Special train of appellant.
