An act passed March 18th, 1796, (Pat. L., *204p. 208,) entitled “An act for the punishment of crimes,” provided in section 73, that no person should be prosecuted, tried or punished for any offence not punishable with death, unless the indictment for the same should be found within two years from the time of committing the offence. This law continued in force, without change, until March 14th, 1879, when a proviso was added to the effect that, for a certain class of offences, a person may be prosecuted, tried and punished “ where the indictment…
