VAN VALKENBURGH, Circuit Judge.
This is a suit by the appellant against tbe Great Western Sugar Company, appellee, to recover tbe sum of $23,500, with interest. It was instituted originally by filing in tbe district court, in the city and county of Denver, Colorado, a petition for alternative writ of mandamus against tbe sugar company, its officers and directors. Tbe cause was removed to the District Court of the United States for tbe District of Colorado, upon tbe ground of diversity of citizenship, and that the proceeding was essentially a suit of a civil nature for the recovery of mouey.
