There is no controversy over the eighty-acre tract of land which John A. Thomas acquired by purchase. The controversy in the circuit court and in this court is in regard to the construction of the will of Gideon Thomas, deceased. In 1856 Gideon Thomas, a farmer of Peoria county, then sixty-five years old, owning a farm of two hundred and fifty-five acres and a large amount of personal property, executed his will. In 1861 he died seized of the farm and personal property valued at $12,000. On the 21st day of March, 1861, the will of the deceased was admitted to probate in the county court of…
