The bill in this .case was brought by a part of the heirs at law of Titus,W. Vigas, deceased, against his other heirs, for a partition of the real estate of which the testator died seized. Surviving the death of the testator, were his widow, (since deceased,) his daughter, Jane, (intermarried with Milton F, Kelley,) and his grand-children, William Vigas, Titus Vigas, Hattie Vigas, and Josephine Vigas, (intermarried with Christopher Doyle,) children of his son, James Vigas, who departed this life before the death of the testator.
