TYLER, District Judge.

This is a personal injury action brought by Carmine Pánico, formerly a registered longshoreman, against American Export Lines, Inc., defendant. American Export impleaded, as third-party defendants, John W. McGrath Corp. (“McGrath”), a stevedoring company, and Societa Par Azioni Di Naviga-zione Genoa “Italia” (“Italian Line”). On December 3, 4 and 5, 1962 the plaintiff’s case was tried before this court and a jury. By stipulation, the third-party claim was to be decided by the court without a jury.
