*875Appeals from an order of the Supreme Court, Erie County (Donna M. Siwek, J.), entered January 23, 2003. The order, inter alia, denied the motion of defendants Stephanie A. Smith and Donald L. Smith and the cross motion of defendant Robert C. Van Pelt for summary judgment dismissing the complaint and cross claims against them.
