Currently before the court is defendant Ventana Medical Systems, Inc.’s (“Venta na”) motion to dismiss Count IV of Digene Corporation’s (“Digene”) Second Amended Complaint (“Count IV”). 1 For the reasons discussed below, Ventana’s motion is granted.
