Plaintiff commenced his action against the defendant "in the district court of Lincoln county for malicious prosecution ■ based on the claim . that the defendant procured the filing of a complaint against the plaintiff for the sale of whisky to the defendant’s minor' son. The criminal complaint' was dismissed by the county attorney.
