Plaintiff brought this suit to quiet title to water containing copper in solution and to require defendants to render an accounting of the copper which they had recovered from the water during the four years immediately preceding the eommencment of this suit. The defendant Joe Dandrea was not served with summons and did not enter his appearance in the cause. Defendant Sam Tog-liatti answered. He denied that plaintiff had any right or title to the water in question and alleged that he was the owner thereof and entitiled to the copper contained therein. A trial was had to…
