This is an action for personal injuries. Plaintiff alleges, in effect, that she rented a house from the defendants, at a month to month rental. Before renting she observed that the stairway leading from the first floor to the basement was in need of repair. She called defendants’ attention to this fact through their agents and made it a condition of her rental that they would repair the same. That they promised and agreed to make such repairs, and maintain said stairway in repair during her tenancy. That said stairway remained in an unsound and unsafe condition until the time of her injury.…
