This is an appeal by Anthony J. Celebrezze, Jr., Attorney General of Ohio, appellant, from a judgment entry of the Lucas County Court of Common Pleas which granted appellee, Grogan Chrysler-Plymouth, Inc., summary judgment on a declaratory judgment complaint. The complaint alleged that appellee’s practice of charging consumers for delivery and handling on new automobiles is an unfair, deceptive and/or unconscionable act pursuant to the Consumer Sales Practices Act (“CSPA”), R.C.
