*801Appeals from an order of the Surrogate’s Court, Oswego County (John J. Elliott, S.), entered August 29, 2002 in a proceeding commenced pursuant to SCPA 1420. The order, inter alia, granted petitioner’s cross motion for summary judgment on the petition.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
