In a petition for rehearing it is suggested that the court overlooked the fact that the declaration contains counts founded in 'contract and in tort, 'and the court is asked to decide all the points argued by counsel for 'both parties so that the opinion may 'be useful in a large number of similar cases now' pending awaiting the determination of the questions presented in this case. The opinion states that the counts are both ex contractu and ex delicto, and the decision is that the liability of the defendant in cases of this general character had been previously adjudged', but that no count…
